This Terms of Service ("Agreement") is a legal agreement between you ("User," "you") and the Speed Cleaner's Team ("we," "us," "our"), governing your access to and use of the "Speed Cleaner" mobile application and any related services (collectively, the "Services").
PLEASE READ THIS AGREEMENT CAREFULLY. BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT DOWNLOAD, INSTALL, ACCESS, OR USE THE SERVICES.
1. Eligibility
You must be at least 13 years old to use the Services. If you are between the ages of 13 and the age of legal majority in your jurisdiction ("Age of Majority"), you represent that your parent or legal guardian has reviewed and agreed to this Agreement on your behalf.
2. License Grant
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on your personal mobile device(s) solely for your personal, non-commercial purposes.
3. Description of Services
The "Speed Cleaner" App is designed to help you optimize and manage the storage on your mobile device. Our Services may include, but are not limited to:
Important Disclaimer: The cleanup and optimization features are provided for your convenience. While we strive for accuracy, WE DO NOT GUARANTEE that every file identified for deletion is absolutely safe to remove. You are solely responsible for reviewing the items selected for cleanup and for any data loss that may occur from using the Services. It is your responsibility to back up any important data before using the cleanup features.
4. Your Responsibilities and Conduct
a. Device Access: To function, the App requires certain permissions on your device (e.g., access to storage). You grant us these permissions by enabling them on your device.
b. No Modification: You agree not to modify, adapt, reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
c. Lawful Use: You agree to use the Services only for lawful purposes and in accordance with this Agreement.
5. Intellectual Property Rights
The App, its original content, features, functionality, and all intellectual property rights therein are and will remain the exclusive property of the Speed Cleaner's team and its licensors. The Services are protected by copyright, trademark, and other laws of both foreign countries and international conventions.
6. Privacy
Your privacy is important to us. Our Privacy Policy (which can be found at https://www.tocper.com/privacy) explains how we collect, use, and protect your information. By using the Services, you consent to the data practices described in our Privacy Policy, which is incorporated into this Agreement by reference.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SPEED CLEANER'S TEAM EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SPEED CLEANER'S TEAM, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
(II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
(III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN;
(IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES;
(V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY.
9. Indemnification
You agree to defend, indemnify, and hold harmless the Speed Cleaner's team and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses resulting from or arising out of your use and access of the Services, or a breach of this Agreement.
10. Termination
a. We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement.
b. Upon termination, your right to use the Services will cease immediately.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of your country/jurisdiction, e.g., Singapore, without regard to its conflict of law provisions.
